ICC Seeks Arrest Warrants for Hamas and Israel Leaders
Arrest warrants are being sought for the leaders of Hamas and Israel for alleged war crimes and crimes against humanity linked to the war in Gaza, as announced by the International Criminal Court (ICC).
Alleged War Crimes
In a statement, ICC Prosecutor Karim Khan mentioned that there were reasonable grounds to believe that Hamas leaders Yahya Sinwar, Mohammed Diab Ibrahim Al-Masri (Deif), and Ismail Haniyeh are responsible for various crimes including murder, extermination, and taking hostages since the Gaza conflict began.
Responsibility of Israeli Leaders
The statement also implicated Prime Minister of Israel Benjamin Netanyahu and Israeli Minister of Defence Yoav Gallant for crimes and crimes against humanity committed in the State of Palestine.
Starvation Tactic Allegations
The allegations include the use of starvation as a method of warfare, intentional attacks on civilians, and murder.
Cooperation with the United Nations
While the ICC is not a UN organization, it collaborates with the United Nations. In situations beyond its jurisdiction, the UN Security Council can refer cases to the ICC.
Victims’ Testimonies
Prosecutor Khan mentioned that his Office interviewed victims and survivors of the Hamas-led attacks in Israel, highlighting the planned and instigated crimes on 7 October 2023.

Expressing gratitude to survivors and families of victims, Prosecutor Khan emphasized the need for accountability and justice for the crimes committed.
Israeli Siege Impact
Details were provided on the impact of the Israeli siege on Gaza, including the deprivation of essential supplies like food and medicine, leading to catastrophic conditions for the civilian population.

Mr. Khan stressed that intentional harm to civilians violates international humanitarian law and called for urgent access to humanitarian aid in Gaza.

The decision on arrest warrants will be made by the Pre-Trial Chambers, and if issued, a Trial Chamber will be created to oversee the legal proceedings.
